Terms and Conditions

I. FIELD OF APPLICATION

The present Terms and Conditions apply to the contractual relationship (“Contract”) between SSEF Instruments Ltd. and the Client (SSEF Instruments and the Client collectively the “Parties”).

2. INFORMATION

Images of products in advertising, brochures, the online shop etc. serve illustration services and are non-binding.

All sales prices published in the online shop are final prices, which the following items are included in the price of the product for Swiss clients : VAT, any prepaid recycling fees, packaging costs, delivery costs, and any other taxes, fees, or costs all taxes (notably VAT).

Goods dispatched to other countries outside of Switzerland may be liable to pay Import Duty, Tax or VAT. When ordering from us you agree to pay any such Duties which may be imposed by your country’s government.

If you refuse to pay any Import Duty / Tax / VAT imposed and thereby prevent delivery of your order you will remain liable for the purchase price of the product/s and any Import Duty / Tax / VAT or penalty imposed by your government.

SSEF Instruments is committed to providing up-to-date and precise information on availability and delivery times in the online shop. However, production and delivery shortages in particular may cause delivery delays for SSEF Instruments. Therefore, all information on availability and delivery times is subject to change.

Together with the order, the Client is given an approximate shipping duration estimate. This estimate relies on information from Swiss Post, FedEx or the service that was used. SSEF Instruments cannot guarantee this time period.

Customers are obliged to immediately inspect the delivered or collected products for correctness, completeness and potential transport damage.

Clients are obliged to immediately inspect the delivered or collected products for correctness, completeness and potential transport damage. Clients shall inform SSEF Instruments of any defects, or false or incomplete deliveries, immediately after detection thereof and within five calendar days after receipt of the delivery/collection at the latest in writing by email.

3. PAYMENT

SSEF Instruments claims all payments for products and services purchased on the SSEF Instruments online shop directly from the customer. 

Payment must be made in Swiss Francs.

Cash payment is possible for in-store collection of products from SSEF Instruments at Aeschengraben 26, 4051 Basel, Switzerland.

4. WARRANTY

SSEF Instruments warrants for two years from delivery date or in-store collection that the ordered product will be free from defects and fully functional.

5. LIABILITY AND EXCLUSION OF LIABILITY

Liability is based on the applicable legal provisions. However, in no event shall SSEF Instruments be liable for (i) slight negligence, (ii) indirect and consequential damage and subsequent damage and loss of profit, (iii) unrealised savings, or (iv) damage resulting from delivery delay, or (v) any acts and omissions on the part of auxiliary persons of SSEF Instruments, be this contractual or non-contractual.

Moreover, SSEF Instruments will not accept any liability in the following cases:

  • storage, setting or use of products that is improper, unlawful or contrary to contract;
  • use of incompatible spare parts or accessories (e.g. power supply);
  • failure to maintain and/or improper modification or repair of the products by our customers or a third party;
  • force majeure, particularly natural hazards, moisture, shock and impact etc. that are not caused by SSEF Instruments.

SSEF Instruments accepts no liability for loss or damage of any kind – whether it be for direct, indirect or consequential damage that may arise from the use of or access to the SSEF Instruments website or from any links to third-party websites. SSEF Instruments does not warrant that the individual parts of the website run flawlessly. Furthermore, SSEF Instruments accepts no liability for any manipulation of the internet user’s IT system by unauthorised persons.

6. APPLICABLE LAW, MEDIATION AND ARBITRATION

This contract is subject to Swiss Law. Any dispute, controversy or claim arising out of, or in relation to, this contract, including regarding the validity, breach, or termination thereof, shall be resolved by mediation in accordance with the Swiss Rules of Mediation of the Swiss Arbitration Centre in force on the date on which the Request for Mediation is submitted in accordance with those Rules. The seat of the mediation shall be Basel, Switzerland. The mediation shall be conducted in English. If such dispute, controversy or claim has not been fully resolved by mediation within 60 days from the date when the mediator(s) has (have) been confirmed or appointed by the Swiss Arbitration Centre, it shall be settled by arbitration in accordance with the Swiss Rules of International Arbitration of the Swiss Arbitration Centre in force on the date when the Notice of Arbitration was submitted in accordance with those Rules. The number of arbitrators shall be one. The seat of the arbitration shall be Basel, Switzerland. The arbitration shall be conducted in English.
